Yesterday, April 9, Kirovsky district court of St. Petersburg has ordered the immediate suspension of the regulations of the State labour inspection across St.-Petersburg about the suspension from work of all employees of JSC "Kirov plant".

Kirovsky district court of St.-Petersburg has considered the statements of JSC "Kirov plant" challenging the provisions of the State labour inspection across St.-Petersburg from 06.04.2015 G. on suspension from work of employees of JSC "Kirov plant" (further - the Instruction) and the suspension of Regulations. The court considered that "there is reason for action to ensure that claim and made a determination regarding the suspension of Regulations prior to the entry into force of the court decision in the case. The definition is subject to immediate execution.

We will remind, the State labour Inspectorate in the city of St. Petersburg (hereinafter - GIT) issued an Order №8-PP/2015-2/219/607/23/4 from 06.04.2015 G., according to which JSC "Kirov plant" (the management structure of the Group of companies "Kirov plant") is obliged to remove from the work with 07.04.2014 G. (this date is specified in the Order) of all of its employees - 435. The reason for this decision was the alleged violation of the procedure of examination of knowledge on labour protection.

Feature Regulations GIT is its unavailability. The document, which aims to "address identified in the state normative demands of labor protection" requires the removal from work of all employees, including the Director General. The validity of the Prescriptions to eliminate violations." Thus, the execution of the order involves the suspension (actually a dismissal) those who only and may resolve the alleged violations. The implementation of this document, in fact, would lead to the blocking of the management company - JSC "Kirov plant", but would affect subsidiaries of the holding company, or workforce, which numbers about 6,000. The fact that it is the "mother" company largely provides administrative, personnel, financial and organizational support of the activities of subsidiaries.

Thus, the Order of the round was capable of inflicting serious damage on the current activities of JSC "Kirov plant" in conditions of the crisis phenomena in the Russian economy, as well as negatively affecting the suspended employee. Their income, in accordance with article 76 of the Labour code of the Russian Federation for the period of suspension would be reduced to 2/3 of the average monthly wage. In addition, subject to the suspension of all workers to accrue wages would be just nobody.
