The Federal service for intellectual property asked two of Essentuki field subsoil user – JSC "Kavminkurortresursy" and "Cold bottling". The essence of the statements is that a number of bottling plants located in the region KMV, lost the right of access of mineral water "Essentuki №4" and "Essentuki №17", produced within the borders of Essentuki field. Contracts for the supply of mineral water that producers signed with mining companies a few years back, the action ceased. However, lost access to mineral water, companies continue to own the evidence of exclusive right to use appellation of origin "Essentuki №4" and "Essentuki №17", which was issued for a period of 10 years. Under cover of these certificates the filling plants continued to produce mineral water under the brand "Essentuki" using water from other fields.

At present Rospatent has taken a decision in respect of LLC "Essentuki brewery", LLC "Elita-Mineral group", OOO "Akva Premium, OOO Sources of Kavkaz", CJSC "Visma", LLC "Trading house "Kavminvod". In January, the Board of Rospatent will consider the application for revocation of APO a few owners of the appellation of origin "Essentuki".

"To use the name "Essentuki №4" and "Essentuki №17" in the production and implementation of the relevant goods may only those companies that have signed with one of the essentukskogo subsoil deposits of the relevant contract supply of mineral water and there is evidence of exclusive right to use appellation of origin, issued by Rospatent. Termination of the contract supply of mineral water on the basis of which was previously issued by the IO, means that the manufacturer loses the right to use the name "Essentuki" in respect of products", – explained the head of legal service of JSC "Kavminkurortresursy" Mikhail Eliseev.

We will remind, earlier "Kavminkurortresursy" and "Cold Filling" was sent to Rospatent the application for revocation of certificates from individuals who do not have access to mineral water. The absolute necessity and appropriateness of the review evidence was noted by the Chairman of the Federation Council Valentina Matviyenko at a sitting of the Federation Council, and during a recent working visit in Kislovodsk, giving instructions to the Rospatent.
